Securities Litigation and Arbitration

 

Description of Practice: Block & Landsman represents public customers, registered representatives and broker-dealers in securities-related claims before the Financial Industry Regulatory Authority (created in June 2007 through a consolidation of NASD Dispute Resolution and the enforcement and arbitration functions of the NYSE), as well as state courts and federal courts throughout the country.

Results: Block & Landsman has achieved significant recoveries on behalf of their clients. Please review the following examples of some of our successes.

Award: Arbitration award of $342,076 on behalf of clients whose broker recommended they use margin to purchase securities, resulting in the loss of their entire account. Award included punitive damages and attorneys’ fees. A copy of the decision can be reviewed here!

Award: Arbitration award of $540,328 on behalf of registered representative against former employer for failure to pay commissions per their agreement, and for sexual harassment and discrimination. Award included punitive damages and attorneys’ fees. A copy of the decision can be reviewed here!

Award: Arbitration award of $231,000 on behalf of public customer who claimed that brokerage firm failed to execute his trades and otherwise were negligent in the handling of his account. A copy of the decision can be reviewed here!

Award: Arbitration award of $150,000 on behalf of public customer who claimed that brokerage firm recommended ricsky technology securities that were unsuitable to her investment objectives. A copy of the decision can be reviewed here!

 Award: Arbitration Award of $100,000 on behalf of widow who claimed that her investment
 advisor maintained a high risk investment strategy that concentrated most of her investment
 funds in a single security. A copy of the decision can be reviewed here!

Award: Arbitration award of $310,000 on behalf of public customer whose investment funds were used to fund private investments created by his advisor. A copy of the decision can be reviewed here!

Settlement: Settlements totaling $700,000 on behalf of three clients of a rogue broker who engaged in a pattern of selling inappropriate mutual funds.

Settlement: Settlement of $650,000 on behalf of a married couple against their financial advisor who implemented an unsuitable investment strategy that was contrary to their conservative goals of safety and preservation of capital.

Settlement: Settlement of $550,000 on behalf of investor against major broker-dealer for lost profits against brokerage firm that failed to execute an options strategy.

Settlement: Settlement of $285,000 on behalf of three families who were victimized by a singular pattern of misconduct of a financial advisor.

Settlement: Settlement of $177,000 on behalf of married couple, one of whom was a former registered representative, for investment losses suffered as a result of their broker’s failure to recommend suitable investments after the husband suffered debilitating injuries in an accident and was no longer able to direct the family’s investments.

Settlement: Settlement of $171,000 on behalf of elderly investor against employer of a financial advisor who improperly convinced her to transfer investment funds to his bogus investment advisory firm.

Pending Cases: We continue to represent the interests of investors and others who have suffered significant losses due to the misconduct of others:

Filed: Arbitration proceeding on behalf of investor against trust company for losses exceeding $500,000 due to a data-entry error in connection with the purchase of a single security.

Filed: Arbitration proceeding on behalf of several investors in an initial public offering who allege they did not receive their shares of the company on a timely basis, resulting in significant losses when the share price dropped.

Filed: Arbitration proceeding on behalf of several investors alleging that brokerage firm selling private investments in a company failed to conduct due diligence which led to the loss of customers’ investments when the company went out of business.

Filed: Class action lawsuit on behalf of current and former registered representatives of UBS Financial Services, Inc., for recovery of underpaid commissions relating to Auction Rate Certificates. Class Action Litigation

 

Description of Practice: Class action lawsuits provide an excellent means of allowing victims of fraud and other wrongdoing to collectively seek recovery for their losses, particularly where they would have little or no recourse on an individual basis. Block & Landsman has successfully pursued numerous class action lawsuits on behalf of a wide spectrum of clients.

Results: Block & Landsman has used class action lawsuits to achieve ground-breaking results.

Elliott v. Chicago Housing Authority: Class action settlement on behalf of 25,000 children residing in publicly subsidized housing that established a one-of-a-kind medial monitoring program in cooperation with area hospitals that was designed to detect neuropsychological injuries known to be associated with lead poisoning.

Lewis v. Lead Industries Association, et al.: Pending class action lawsuit on behalf of parents of all children residing in areas throughout Illinois designated as posing high risk of exposure to lead-based paint. Opinions by the Illinois Appellate Court created precedent by establishing the right of these parents to collectively sue the makers of white lead pigment for conspiring to conceal the dangers their product posed to young children. The case was recently certified as a class action by the trial court.

Settlement: Class action lawsuit on behalf of limited partners where we obtained a preliminary injunction stopping a $160 million defensive recapitalization of a publicly-held limited partnership.

Settlement: Class action lawsuit against a mortgage lender that improperly charged its clients a $50.00 fee if they paid off their loans prior to the maturity dates.

Settlement: Class action lawsuit on behalf of 2,000 criminal investigators against their employer, the U.S. Postal Service, for failure to pay overtime wages.

Settlement: Class action lawsuit on behalf of homeowners who were improperly charged fees for obtaining payoff statements from a mortgage loan servicing company.

Settlement: Class action lawsuit against a national title insurance company for charges improperly assessed to homeowners who sold or refinanced their properties.

Pending Cases: We continue protecting the rights of clients who have been systematically defrauded by a wide range of misconduct. For example, currently pending in the U.S. District Court for the Northern District of Illinois is a class action lawsuit on behalf of current and former registered representatives of UBS Financial Services, Inc., for recovery of underpaid commissions relating to Auction Rate Certificates. Commercial Litigation

 

Description of Practice: Block & Landsman represents businesses and individual business professionals in a variety of contractual and fraud disputes, claims for tortuous interference with business, trademark cases, commercial lease disputes, ERISA claims and commercial collection matters.

Results: We have consistently recovered substantial sums on behalf of our commercial clients. We have successfully negotiated resolution of numerous labor and employment-related contract disputes on behalf of a multitude of business owners and independent contractors. We also obtained a jury verdict in the amount of $250,000 on behalf of a former employee alleging discrimination against a national restaurant chain.

Filed: Lawsuit on behalf of a manufacturer against a nationally recognized retailer for tortuous interference with its current and prospective clients.

Filed: Lawsuit on behalf of licensor against an international manufacturer/distributor alleging breach of an exclusive national license agreement.
